These Terms & Conditions of Sale (the "Terms") govern the contractual relationship between RTC Prestige — operated by MEDJDOUB Meustapha (SIREN 902 963 370), 1 rue Frankenthal, 92700 Colombes, website reserve-ton-chauffeur.fr — and its clients, in connection with the booking and provision of chauffeur-driven passenger transport services (VTC).
Article 1 — Purpose
The purpose of these Terms is to define the conditions applicable to the transport service contracts entered into between RTC Prestige (reserve-ton-chauffeur.fr) and its clients. By using RTC Prestige's services, the Client is deemed to have read and fully accepted these Terms.
Article 2 — Formation of the transport service contract
The Client may request a service 24/7 on the website reserve-ton-chauffeur.fr or by phone at +33 1 84 60 30 57. The Client provides all information relating to the service request. The Client alone is responsible for this information, of which the following is considered essential to the contract: date of the transport service, pick-up location, drop-off location, pick-up time, number of passengers (adult/child), number of bag(s), nature of the service (transfer, hourly hire). RTC Prestige sets the price of the service based, in particular, on the information provided by the Client.
Payment is made by bank card through a secure electronic system. By providing their bank details, the Client accepts in advance and unconditionally that RTC Prestige carries out the secure transaction and authorises in advance their bank to debit their account for the amount of the service. After the Client confirms their request and pays the price, RTC Prestige sends back, by email exclusively, a booking confirmation summarising the service details. The Client is responsible for checking the information shown on the booking confirmation. If RTC Prestige is unable to send said booking confirmation by email, the booking is presumed to conform to the Client's request.
Article 3 — Pricing
RTC Prestige sets the price of the service based, in particular, on the information provided by the Client. Accordingly, the prices shown in our rates include VAT, applied at the rate set by the regulations in force for transport services (i.e. 10% for transfers and 20% for hourly hire).
These rates also include the chauffeur service, fuel and unlimited insurance for the persons transported. Tolls are likewise included in the transport.
However, parking fees are not included in the service and remain payable by the Client.
Article 4 — Payment
Accepted payment methods: cash, bank cards (Visa, MasterCard, American Express, etc.) and bank transfer. Any transport service, whether a transfer or hourly hire, is payable upon ordering.
Article 5 — Booking and cancellation
5.1 — Booking
Any booking implies unreserved acceptance of these Terms. The Client and the provider thereby undertake to comply with all clauses set out in this contract. Furthermore, no change may be made to the above conditions except by prior agreement between the parties.
However, this contract shall be suspended or automatically cancelled, without compensation of any kind, in all recognised cases of force majeure, i.e. an event external to RTC Prestige such as: disruption of traffic routes, bad weather, demonstrations, accidents, breakdowns or malfunctions of telecommunications networks, shortage of labour or equipment.
Consequently, the contract is deemed concluded only from the moment payment of the order is actually collected. Failing this, it is automatically void.
Consequently, any booking of a car with driver is mandatory and must be made at least 24 hours in advance through the website, or at the last minute by phone subject to availability.
Special note for a pick-up at a station or airport:
- As soon as you arrive, turn on your mobile phone.
- Please note the flight or train number in "additional information" when booking.
- For flights, if you have no checked baggage in the hold, the 15 minutes of waiting included in the ride are generally sufficient. However, if you need to collect checked baggage and/or you are arriving from a non-European destination, the time to leave the plane, collect baggage and any police checks require fairly significant delays.
- To avoid paying for waiting time, we advise adding a 50-minute buffer.
5.2 — Cancellation
A booking may be cancelled by the Client, before the pick-up time indicated on the booking confirmation, either by email to contact@reserve-ton-chauffeur.fr or by phone at +33 1 84 60 30 57:
- 100% refund if cancellation occurs more than 24 hours before the pick-up time.
- 50% refund if cancellation occurs more than 12 hours before the pick-up time.
- 0% refund if cancellation occurs less than 12 hours before the pick-up time.
5.3 — Price surcharge / Delay
Any delay of the passenger(s) relative to the pick-up time indicated on the booking confirmation results in a surcharge on the price of the service, where the Client notifies the chauffeur by phone at +33 1 84 60 30 57, according to the following terms:
- More than 15 minutes late: €15
- More than 30 minutes late: €30
- More than 60 minutes late: €50
Payment of these surcharges is due at the latest when the passenger(s) board the vehicle.
Immediate booking: if the Client is absent from the meeting point beyond the first 15 free minutes and without any sign from them or answer to the chauffeur's phone call, the service will be definitively lost. It will therefore be impossible to reschedule the trip or claim any refund (payment made in advance). Furthermore, in the case of payment on board, an invoice will be issued for the amount of the booking.
Advance booking: likewise, if the Client is absent from the meeting point, the service will be definitively lost. Consequently, no rescheduling will be possible and no refund may be claimed (payment made in advance). However, in the case of payment on board, an invoice will also be issued for the amount of the booking.
Article 6 — Quality of service
Paid passenger transport is a regulated activity. Only authorised vehicles may provide this service, namely those:
- holding a professional card number issued by the prefecture;
- holding a registration certificate issued by the Ministry of Ecology, Sustainable Development and Energy (Office for the organisation of road passenger transport / VTC unit);
- displaying a registration sticker affixed to the vehicle's windscreen.
RTC Prestige undertakes to carry out or have carried out the transport services in accordance with the booking confirmation and in compliance with all regulations and legislation in force.
In the event of subcontracting, RTC Prestige ensures that the individuals and companies it engages meet the same conditions.
Article 7 — Liability
RTC Prestige is covered by a notoriously solvent insurance company that covers the risks related to its activity, in accordance with the regulations in force.
In the event of a dispute, RTC Prestige's liability may only be engaged provided the Client proves wrongful conduct on the latter's part and a causal link with the alleged damage.
RTC Prestige's unlimited comprehensive insurance covers the liabilities related to the company. The Client is responsible for their actions, both civilly and criminally.
7.1 — Liability of the client and the persons transported
The Client and their passengers undertake to behave properly from pick-up, in particular by respecting the chauffeur, the vehicle and the following rules:
- Compliance with the Highway Code (seatbelt, car seat, booster seat, etc.).
- No smoking, eating or transporting dangerous materials.
- No consumption of alcohol on board.
- Luggage is under the Client's responsibility. The company is not liable in the event of damage or loss.
- Any damage to the vehicle is payable by the Client.
- For damage immobilising the vehicle: billing at actual cost + immobilisation fees + loss of earnings. Cancellation of the following service incurs a flat fee of €150.00 payable immediately by bank card.
- Cleaning in the event of vomit is charged at €150.00 incl. VAT, payable immediately by bank card.
- Small pets are accepted in a transport crate. Assistance dogs are admitted.
Failure to comply with these rules engages the exclusive liability of the Client and passengers. The company declines all liability for its Client's actions before and after transport. RTC Prestige may refuse or remove a passenger who does not comply with these rules or who is intoxicated.
7.2 — Complaints
Any complaint must be made within 5 days following the service. Any dispute falls under the courts of the registered office of the VTC company.
Article 8 — Hourly hire / Transfer
8.1 — Transfer
The transfer begins at RTC Prestige's registered office and ends at the intended address.
8.2 — Hourly hire
For hourly hire, transport is subject to limited mileage:
- 10 kilometres per 1 hour of hire,
- 50 kilometres per 5 hours of hire.
Any hour started is due in full.
Article 9 — Personal data
The information collected at booking is used exclusively to carry out the service and is neither sold nor disclosed to third parties, in accordance with the applicable personal data protection regulations.
Article 10 — Governing law and disputes
These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority before any legal action.
